Receipt of information from the company TESGAS S.A. on the non-extension of the bid bond securing the offer for the “Construction of Gas Pipeline DN700 Hermanowice – Strachocina”.

CONTENT OF THE REPORT:
The Management of Izostal S.A. (the Company), in reference to the current report No. 33/2016 of 28th October 2016, informs that on 28th December 2016 the Company received a letter from the company TESGAS S.A. (the Consortium Leader), informing about the non-extension by the Consortium Leader of the bid bond securing the offer made by the Consortium consisting of the following companies: 1) TESGAS S.A., 2) IZOSTAL S.A., 3) STALPROFIL S.A. (The Company became a member of the Consortium by way of universal succession – after the incorporation of the subsidiary ZRUG Zabrze S.A.), 4) Friedrich VORWERK KG (GmbH & Co.), in the tender procedure organised by the OGP GAZ-SYSTEM S.A., based in Warsaw (the Ordering Party), for the “Execution of construction works for the investment project: ‘Construction of Gas Pipeline DN700 Hermanowice – Strachocina’”.

In connection with the non-extension of the bid bond by the Consortium Leader, the Consortium’s offer is not secured with a bid bond from 28th December 2016, in result of which – pursuant to Art. 24 Paragraph 2 Point 2 of the Public Procurement Law (PZP), in the version in force on the date of the public procurement procedure notice – a contractor whose offer is not secured shall become excluded, and in consequence – pursuant to Art. 24 Paragraph 4 of the PZP – the contractor’s offer shall be rejected.
